因為 5 年前的這起事件，印度開始審理同性戀性是否合法化
日前印度的最高法院憲法法庭開始由 5 名法官組成合議庭，針對將同性戀視同犯罪的《印度刑法第 377 條》是否違憲進行審理。而這場引發高度關注的憲法違憲案也讓不少同性戀及人權團體燃起希望，他們期望能藉著這場聽證會，讓同性戀在印度得以合法化。
印度刑法第 377 條
印度刑法第 377 條是從 1860 年代，即英國殖民印度時便開始實施的法律，法條規定「任何人與男、女、動物發生違反自然定律的性行為將被判終身監禁，或最高至 10 年的有期徒刑。」
雖然這項條文在英國早已廢除，但仍存留在印度、新加坡、馬來西亞等曾遭英國殖民過的國家，且由於法條本身隱晦不清，讓第 377 條時常淪為執政黨用來打擊反對黨人士、警方用以迫害同性戀，甚至是恐同者用以攻擊同性戀的武器。
同性戀在印度曾經合法過？
2009 年，德里高等法院曾以「違反人權」為由，判決第 377 條因牴觸憲法而無效，並希望印度國會重新討論對第 377 條予以更改或加註的可能性。由於這項判決，同性戀性行為曾短暫合法化，不再被國家視為罪刑。
然而，在保守團體的上訴之下，最高法院在 2013 年推翻了德里高等法院的裁定，認為第 377 條法案的爭議不應該由司法部門解決，而是應該交由立法部門來處理，判定刑法第 377 條仍舊有效，此後，同性戀者再度陷入隨時必須坐牢的恐懼。
此次的聽證會有何意義
而今，最高法院憲法法庭將對印度刑法第 377 條是否違反了印度憲法第14條「在法律面前人人平等」；第15條「禁止對於宗教、種族、種姓、性別或出生地的歧視」，及第21條「保障生命安全和個人自由」等基本權利作出裁定。
根據《衛報》，這場聽證會史無前例地集結了許多著名的同性戀者、酒吧老闆、著名廚師和古典舞蹈家，他們詳細講述了印度刑法第 377 條是如何破壞他們的生活、使他們感到羞恥，並直接影響到他們擁有幸福的機會。
對於印度的 LGBTQ 族群來說，第 377 條的存廢並不只挑戰了印度社會對於同性戀的觀點，同時，也涵蓋了更根本也更深層的問題 ＿ 生而為人的基本權利。
